How does the Americans with Disabilities Act affect workers’ compensation programs?

The Americans with Disabilities Act prohibits an employer from inquiring into an applicant's workers’ compensation history before making a conditional offer of employment. After a conditional job offer has been made, an employer may then inquire about a person's workers’ compensation history. The employer may do so only if a medical inquiry or examination is required of all applicants in the same job category. However, under the Americans with Disabilities Act, an employer may not base an employment decision on the possibility that an applicant may cause increased workers’ compensation costs in the future.
